Article 1 (Purpose)

These Terms set out the rights, obligations and responsibilities of Musimusihan Smoothie (the “Company”) and its users, and other necessary matters, in connection with use of the mobile application ProofKit (the “Service”) provided by the Company.

Article 2 (Definitions)

Article 3 (Effect and amendment of these Terms)

  1. These Terms take effect when posted on a Service screen or by another method determined by the Company.
  2. The Company may amend these Terms within the bounds of applicable law. When it does, it will state the effective date and the reason for the amendment and give notice within the Service or on this page at least 7 days before that date — at least 30 days before, where the change is unfavourable to users or otherwise material.
  3. A user who continues to use the Service after the effective date of an amendment is deemed to have agreed to it. A user who does not agree may stop using the Service and delete their account.

Article 4 (Provision and modification of the Service)

  1. The Company provides features including creating, joining and sharing spaces, inviting others by invite link, writing and viewing records, and notifications.
  2. The Company may change or discontinue all or part of the Service where operationally or technically necessary, and will give notice within the Service beforehand. Where this is unavoidable — for example, responding to an urgent fault — notice may be given afterwards.
  3. The Company may carry out regular or ad-hoc maintenance to keep the Service stable, and will announce maintenance windows in advance through in-Service notices.

Article 5 (Registration and accounts)

  1. A user becomes a member by completing registration through a method determined by the Company (email, Google, Apple, Kakao, Facebook, LINE).
  2. If the information provided at registration changes, the user must update it within the Service without delay. The Company is not responsible for disadvantages arising from a failure to do so.
  3. Users are responsible for managing their own account and sign-in credentials and may not transfer or lend them to a third party. A user who becomes aware of account theft or unauthorised use must notify the Company immediately.

Article 6 (User obligations)

Users must not do any of the following.

Article 7 (Records and copyright)

  1. Copyright in a record a user writes in the Service belongs to the user who wrote it.
  2. By the nature of a space, records a user leaves are visible to other users who have joined the same space, and the Company may store, transmit and display them within the scope needed to provide the Service. Details follow the Privacy Policy.
  3. Deleting a space irreversibly deletes that space's records and attached photos. If a user leaves a space, the records they left remain in the space for the other participants.
  4. Users must not attach works owned by others to records without permission, and are responsible for any dispute arising from doing so.

Article 8 (Paid Service, subscription and payment)

  1. The Company may offer ProofKit Pro subscription products for a fee, providing add-on features such as photo attachments and additional templates.
  2. Subscription prices and billing periods (monthly/yearly) follow what is shown on the payment screen of each store (Google Play, App Store) and renew automatically unless a different period is specified.
  3. Payment, automatic renewal, cancellation and refunds are handled through each store's payment system and policies. The subscription management screen in the app links out to each store's subscription page.
  4. Unless the user cancels, a subscription renews automatically on its expiry date; cancellation takes effect from the next billing period and does not affect a period already paid for.
  5. Refunds follow the refund policy and procedure set by each store (Google Play, Apple). The Company does not process refunds directly.
  6. Where the owner of a space is a Pro subscriber, other users who have joined that space can also use Pro features within it. When the owner's subscription expires, the Pro features of that space end as well.

Article 9 (Restriction of use and termination)

  1. If a user breaches Article 6 or interferes with the operation of the Service, the Company may issue a warning, restrict certain features, or suspend use, after prior notice — or after the fact where the matter is urgent.
  2. A user may terminate the agreement (delete their account) at any time through “My Page > account card > Delete account” in the app. What is deleted on account deletion follows the Privacy Policy.
  3. Where a paid subscription is running, cancelling it must be done separately at the relevant store, independently of deleting the account.

Article 10 (Disclaimer)

  1. The Company is relieved of responsibility where it cannot provide the Service due to force majeure, such as a natural disaster, power failure or communications outage.
  2. The Company is not responsible for the content of records users post in the Service, and has no obligation to intervene in disputes between users.
  3. The Company is not responsible for problems using the Service that are attributable to the user.

Article 11 (Disputes and governing law)

  1. These Terms are governed by and construed in accordance with the laws of the Republic of Korea.
  2. Any dispute between the Company and a user arising in connection with use of the Service may be brought before the court having jurisdiction under the Korean Civil Procedure Act.
  3. Enquiries about using the Service can be submitted through “My Page > Contact us” in the app or the contact details below.

Addendum

These Terms apply from 31 August 2026.

Addendum 2 (Special terms for users who downloaded from the Apple App Store)

These special terms apply only where you downloaded and use the Service through the Apple App Store, and prevail over other provisions of these Terms to the extent of any conflict.

  1. (Parties) These Terms are concluded between the Company and you. Apple Inc. ("Apple") is not a party to them. The Company alone is responsible for the Service and its content.
  2. (Scope of licence) The Company grants you a non-transferable licence to use the Service on any Apple-branded product that you own or control, as permitted by the Usage Rules of the App Store Terms of Service. The Service is licensed to you, not sold.
  3. (Maintenance and support) The Company alone provides maintenance and support for the Service. Apple has no obligation whatsoever to furnish any maintenance or support.
  4. (Warranty) The Company alone is responsible for any warranties relating to the Service. In the event the Service fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the Service. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to any warranty are the Company's sole responsibility.
  5. (Product claims) The Company, not Apple, is responsible for addressing any claims by you or a third party relating to the Service or your possession and use of it, including but not limited to product liability claims, claims that the Service fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or privacy law.
  6. (Intellectual property) In the event of a third-party claim that the Service or your possession and use of it infringes that party's intellectual property rights, the Company, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.
  7. (Legal compliance) You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  8. (Company name and contact) Questions, complaints and claims regarding the Service may be submitted to the contact details in Article 11 of these Terms.
  9. (Third-party terms) You must comply with any applicable third-party terms of agreement when using the Service.
  10. (Third-party beneficiary) Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
